逼下跪道歉 恐涉刑法強制罪嫌

日劇《半澤直樹》襲捲全台，不僅劇中的「土下座」引起網友討論，甚至近來陸續出現疑似逼下跪道歉的傳聞，不過，法界人士提醒，如果涉犯法律應由法律制裁，不得私下以不當處罰方式。法界人士表示，逼下跪可能觸犯刑法強制罪嫌，被要求者也有權說「不」。

「土下座」是日本傳統禮俗，犯了錯要人家原諒你，就要用「土下座」展現最高規格的歉意。雖然台灣沒有「土下座」，但近來卻也陸續傳出和下跪相關的新聞，日前在南鐵東移座談會上，就有鬧事的學生們自己下跪之外，也要市長賴清德比照辦理，雙方爭執氣氛火爆。七號則是有人控訴電視台女主播，在日月潭雲品飯店怒嗆SPA館員工下跪道歉事件。

根據刑法第304條強制罪規定：「以強暴、脅迫使人行無義務之事，或妨害行使權利者，處三年以下有期徒刑、拘役或三百元以下罰金。」法界人士表示，不得私下以不當處罰方式處罰別人，被要求者也沒有義務要配合，因此，逼下跪的方式，就觸犯強制罪嫌。法界入士進一步提醒，如果採取剝奪行動自由等更激烈的手段，甚至還有妨害自由罪嫌的問題，受害人應勇於報案。
