有關資遣費新制的算法

1)雇主必須每個月提撥6%勞退至你勞保局專戶
你可以以自然人憑證24小時至勞保局網頁查詢,是否提撥?
或持身分證至勞保局查詢(不需手續費)
或以勞動保障卡至ATM查詢。

2)有些人在雇主未提撥勞退狀況下,會要求資遣費以舊制算,但我不建議,除非
這老闆跑路,你怕夜長夢多,不然以舊制算,其實你比較虧。
例如:你的投保薪資22800(我假設你從未調過薪)
22800*6%*36個月=4萬9248
22800*0.5基數*3年資=3萬4200
共8萬3448
6%*12個月+50%=122%

若你要求舊制算法
22800*1基數*3年=6萬8400
100%(舊制無6%勞退提撥)
122%>100%
其實更少!

3)若查詢提撥,雇主未提撥,應另外求償6%勞退(離職後5年內可求償),資遣費仍以新制計算(94/7/1以後任職,一律以新制算,一年0.5個基數),你雇主的算法是正確的,只是加班費要算入,且要算未扣勞健保前的薪資

4)資遣費應在資遣日後30天內你,建議你別拖
預告工資30天,若資遣前半年平均薪資是22000,那就是22000
未休特休可換算特休代金
非自願離職證明~~失業給付、職訓生活津貼、健保補助用
