漏水或凶宅 看屋時全揭露

昔日民眾購屋，不小心買到地層下陷區、緊鄰基地台，或九二一地震時結構體受損住宅，申訴無門，只能打官司討公道的情況可望改善。內政部地政司將大幅增列不動產說明書應記載事項，要求載明基地安全性，附近有無嫌惡設施，房屋過去有無火災、凶殺等「特殊經歷」，連建商或賣方附贈家具家電，解違約須面對的懲罰性條款，全都要完整揭露，新制最快年底前實施。

地政司官員指出，過去對於凶宅等規定，只限於成屋買賣契約應記載事項中，只有在簽約時才會進行確認，不動產說明書則是民眾看屋時，就可要求房仲業提供。

草案修正重點包括：第一是土地建物登記應清楚說明，如有民眾到鄉間買地想蓋農舍，卻因買到水利用地或國土保安地，根本不能建，未來將可透過檢視不動產說明書進行確認。

第二是基地本身全安性納入規範，如土地遭到汙染、緊鄰活斷層、位處嚴重地層下陷區等都須載明。第三，住家附近有基地台、垃圾場、高壓電塔、殯儀館等嫌惡設施應載明清楚。
