定型化房屋契約 保障不夠

〔自由時報記者林嘉琪／台北報導〕新修正的「成屋買賣定型化契約」範本五月上路，但消基會委員林旺根昨日指出，新上路的「房屋契約範本」無法保障消費者，因為消基會常接獲消費者投訴，買屋成交後才發現是海砂屋或凶宅，或是漏水、壁癌問題常發生，依政府日前通過的「房屋契約範本」根本無法得到保障，有時受到賣方或仲介隱瞞，無法完全掌握資訊，常有人花了大錢買到劣質屋。

消基會昨天呼籲，「房屋契約範本」應該把適用人從原本的建商擴大到消費者之間的房屋買賣活動，並修正範本內容，讓房屋資訊更完整。

消費者報導雜誌發行人陳智義表示，目前依消保法定義，修正案適用對象只針對「有消費關係」的業者與消費者，對於一般經由仲介的交易，由於賣方不是業者則不受拘束，要是一旦發生糾紛，買方只能循民事訴訟程序自力救濟。
